This website https://www.latinasinconstruction.net (hereinafter, the Website), is owned by Latinas in Construction located at 1050 Connecticut Avenue NW, Suite #500, Washington DC, 20036.
2. INTRODUCTION
This document and all the documents mentioned in it, establishes the conditions governing the use of this Website and the purchase and delivery of the Trainings listed on the aforementioned website (hereinafter the Trainings).
We kindly ask you to read these documents carefully, these Terms and Conditions, our Cookies policy and our Privacy Policy before using this website. By using this web page and registering as a User or Student through it, you consent to be bound by them.
"User" shall be understood as the natural or legal person who, after accepting these Conditions, creates an account or registers as a student in one or more Trainings taught by the owners of this website.
The acceptance of these General Terms and Conditions is mandatory and essential for the purchase of the Training. Therefore, such acceptance must take place at the time of registration of the User in the Training.
These Conditions will govern the relationship between the Parties, Latinas in Construction and the User). Latinas in Construction reserve the right to modify the Terms and Conditions that, if applicable, have been established for the subscription to the Training through the Website, when it deems appropriate or for the purpose of to adapt said texts to legislative and technological changes, being valid and taking effect from the publication on the Website of the new versions. The temporary validity of these Terms and Conditions coincides, therefore, with the time of their exposure, until they are totally or partially modified, at which time the modified conditions will come into force, said modifications will not affect in any case the subscriptions made prior to its entry into force.
3. OBJECT
Latinas in Construction, through this website, provides several online training services, called the Trainings.
The Trainings give Users a right of access to the training described on this Website, provided that Users comply with these Terms and Conditions. The educational material of the Trainings available on this Website is exclusively for private use. The services offered are only accessible to students subscribed to the Training(s). By subscribing as a student in the Training(s), the User agrees to comply with these Terms and Conditions.
The description of each Training is listed on this Website, including number of hours, schedules, start and end date, price, and others.
Training has the nature of non-regulated teaching and does not lead to obtaining a degree with official value. No academic degree is required to teach this Training. Faculty at Latinas in Construction, are professionally qualified to teach and trained in the methodology developed and applied by Latinas in Construction.
4. ACCESS TO THE TRAININGS AND USE OF THE WEBSITE
The User of the Training must be of legal age and will be responsible for providing truthful and lawful information, guaranteeing the authenticity of all the data entered when filling in the pre-established forms for registration in the Training.
The use of the Training offered on the website by any third party that uses an identifier and password provided to the User for this purpose, due to non-diligent action, voluntary supply or loss of the same by the User, will be the sole responsibility of the User.
By virtue of the foregoing, it is the User's obligation to immediately notify Latinas in Construction, of any fact that allows the improper use of identifiers and/or passwords, such as theft, loss, or unauthorized access to them, in order to proceed with their immediate cancellation. As long as such facts are not communicated, Latinas in Construction will be exempt from any liability that may arise from the improper use of identifiers or passwords by unauthorized third parties and any request, use, provision and / or contracting of products or services will be understood to be carried out by the User himself, being the latter, consequently, the only one responsible for said acts.
The access, navigation and use of the Website and the use or contracting of the Training is made under the sole and exclusive responsibility of the User, for which reason the latter undertakes to diligently and faithfully observe any additional instructions given by Latinas in Construction, or by authorized personnel of Latinas in Construction, regarding the use of the Website and its contents.
Likewise, the User undertakes to use the contents of the Training in a diligent, correct, and lawful manner, in accordance with current legislation.
5. PRICE AND PAYMENT
User can check the updated price of the Training on this Website.
The User can pay for the Training safely with a debit or credit card (VISA, Mastercard) or via Paypal, Zelle, Venmo and CashApp.
In the payment platform associated with the Website, the data required for this must be entered in the fields provided for this purpose. To finish contracting the Training, User must follow the online purchase procedure and click on "Pay with Card". After completing the purchase, User will receive an email acknowledging receipt of order (the "Order Confirmation") along with the invoice. Registration for the Training will become effective once the previous operation has been validated.
Latinas in Construction reserve the right to change prices or propose special promotions, among other things, at any time, after posting on the website for a reasonable time and informing members by email. Possible changes will not affect registrations that have already been made.
6. REGISTRATION IN THE TRAINING
Enrollment in the Training is guaranteed as long as there are places available and the payment has been made and in good time by the User.
The Training begins once the User registers and from the moment he receives the access codes. Enrollment in the Training can be done at any time of the year.
The payment of the Training entitles the User to access a single Training or level, being able to choose between: Beginner, Intermediate and Advanced, as appropriate. Once the Training begins, students will take a placement test, if necessary, the result of which will be used by Latinas in Construction, to recommend the level that best suits students’ learning needs. Within a period of seven (7) business days from the start of the Training, the User may request a level change.
The Training lessons are available during the contracted access period, so if they are not used before the end of the subscription period, the unused lessons will be lost and will not be refunded. Training is not transferable nor refundable.
7. RIGHT OF CANCELLATION
The User, if contracting as a consumer and user, will have the right to cancel and void the registration in the Training through the Website, without the need to justify their decision and without penalty of any kind, seventy-two (72) business hours before the start of the Training. The User waives the Right to Cancel their registration in the Training(s) if the registration occurred in a period of less than seventy-two (72) business hours before the Training begins.
Latinas in Construction advises the User to communicate their intention to cancel the contract by calling 571-332-0083 or by email at edith@latinasinconstruction.net. To comply with the cancellation term, it is enough that the communication regarding the exercise by User of this right is sent before expiration of the corresponding term.
In the aforementioned event of Cancellation, Latinas in Construction, will proceed to return the payment received without undue delay and, in any case, no later than fourteen (14) business days from the date on which that we be informed of your decision to cancel this contract, provided it was received seventy-two (72) hours before the start of the Training. Latinas in Construction will proceed to make said refund using the same means of payment used by User for the initial transaction. Users will not incur any expenses as a result of the refund. If cancellation is not received by Latinas in Construction, seventy-two (72) hours before the start of the Training, no return of payment will be made.
8. PRIVACY POLICY
The Privacy Policy forms an integral part of these Terms and Conditions. The User must read and know the Privacy Policy; whenever you provide or facilitate personal data through the Website.
The information or personal data that User provide us will be treated in accordance with the provisions of the Privacy Policy. By using this website, the User or Student consents to the processing of said information and data and declares that all the information or data that User provides us is true and real.
9. COMMUNICATIONS
For any communication between Latinas in Construction, and the User, the User must contact Latinas in Construction, at the postal and/or electronic address indicated below. In any case, communications from Latinas in Construction to the User will be made to the contact information provided or provided, preferably electronically. For this purpose, the User expressly accepts the use of email as a valid procedure for the exchange of information and the referral of communications between and/or with Latinas in Construction.
10. GENERAL
The headings of the different clauses are for information only, and will not affect, qualify or modify the interpretation of the Terms and Conditions. In the event of a discrepancy or contradiction between what is established in these Terms and Conditions and the particular conditions that, if applicable, may be established with respect to the Training offered on the Website, the provisions of the particular conditions will prevail. In the event that any provision or provisions of these Terms and Conditions were considered void (s) or inapplicable (s), in whole or in part, by any Court, Tribunal or competent administrative body, said nullity or non-application will not affect the remaining provisions of the Terms and Conditions or the particular conditions that, where appropriate, may have been established. The non-exercise or non-performance, by Latinas in Construction, of any right or provision contained in these Terms and Conditions shall not constitute a waiver thereof, unless acknowledged and agreed in writing by you.

12. APPLICABLE LEGISLATION AND COMPETENT COURTS
These Terms and Conditions and the relationships established between Latinas in Construction and the User, in particular the knowledge and resolution of any disputes, discrepancies or differences that may arise, will be governed, and resolved in accordance with the provisions of the Washington, DC regulations regarding applicable legislation and competent jurisdiction.
